Terms Of Service
http://www.awebsite4u.com In this contract, "AWebsite4U" and "ICT" means Innovative Computing Technologies Inc. and "Client" means . ICT has been contracted by Client to provide the following services:

Design and publish a commercial web site.
Provide all HTML programming necessary to produce the web site.
Utilize digital photographs provided by Client, or, at additional cost, ICT will provide digital photography or image scanning at the request of Client.
Publishing of all web site content at a web hosting service contracted by ICT. The Client also agrees to allow ICT to place it's logo and a link to the ICT web site in a prominent location on the Client's web site.
Domain name registration will be submitted by ICT through a domain name registration service which will be contracted by ICT. Client agrees to provide three domain name choices listed in order of preference. Client acknowledges that ICT has no control over availability of requested domain names and agrees to accept the domain name that has been assigned by the domain name registration service.

In exchange for these services, Client agrees to pay ICT the sum of $ , payable upon completion of all design, photography and publishing associated with the web site. This includes all programming, photography, photo scanning and publishing of the web site.
A deposit in the amount of $ , which is 25% of the estimated price, excluding tax and setup costs, will be paid by Client before any work will begin. The deposit is NOT refundable.

Additional charges payable upon delivery, are as follows: $ web host set up fee $ domain name registration (optional) In addition to the one-time set up charges, Client agrees to pay ICT a monthly service charge of $ , which is to cover the cost of the web hosting service contracted by ICT. Client understands that failure to pay this monthly maintenance fee will result in the termination of the entire web site. Reactivation of the web site will require all setup costs to again be paid by Client.
Client agrees that all HTML files, digital photographs, scanned images and any other material or media created by ICT is the exclusive property of ICT and may not be copied, distributed, duplicated or published in any manner without written permission from ICT. These items will remain the property of ICT for the duration of the contract period. By signing this contract, the Client agrees to continue monthly payments until the end of the contract period. The contract period is one year and begins on the day that ICT completes site setup with web hosting service.

ICT accepts no responsibility for damages resulting from the use of this product and makes no warranty or representation, either express or implied, including but not limited to, any implied warranty or merchantability or fitness for a particular purpose. ICT also accepts no responsibility for the reliability of the web site hosting service, or the availability of the web site or it's content due to any down time or disruption of services provided by the web hosting service. ICT has selected a web hosting service based on it's published reputation and cost effectiveness. ICT reserves the right to replace this web host service as ICT deems necessary. Client agrees to pay any additional charges incurred as a result of any such change. Client also agrees to pay any additional charges incurred as a result of any price increase by the selected web site hosting service.

Material provided by Client:
ICT will publish material provided by Client at no additional charge provided the material is presented to ICT in the following standard formats:
Acceptable formats for pictures are jpg, gif, bmp, tif, png, pcx
Acceptable formats for typed material, documentation, etc are Plain Text (.txt), MS Word (.doc), MS Excel(.xls) Rich Text (.rtf)

Other formats may also be acceptable, however there may be additional charges for converting those formats into a format that ICT is able to publish. Client must ALWAYS contact ICT before obtaining or submitting material in any format not mentioned in this contract. There may also be additional charges if material is presented to ICT in non-electronic format or at any time where, at the discretion of ICT, extensive typing is required.

The Client is responsible for ensuring that all material submitted to ICT for web publication does not violate any copyright. Client accepts all responsibility of ensuring that all published material may be reproduced and published for commercial purposes. The Client understands that the owner of all such material may require written permission to be granted in order to use these materials. This applies to ALL material with the exception of original art work, photography and programming created by ICT.
